Terms of Service

1. Agreement to Terms

By accessing or using MotionPlay software and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

MotionPlay provides interactive projection gaming software for commercial entertainment venues. The Service includes:

  • Desktop application for Windows
  • Web-based customer portal
  • Game content accessible through subscription or perpetual license
  • Sensor calibration and touch detection features

3. Subscription and Payment

3.1 Plans: We offer Trial (free, 30 days), Starter, Pro, and Perpetual license options.

3.2 Billing: Subscription fees are billed in advance on a monthly or annual basis. Perpetual licenses are one-time payments.

3.3 Refunds: Subscription fees are non-refundable except as required by law. Perpetual licenses may be refunded within 14 days if the software has not been activated.

3.4 Taxes: All prices are exclusive of applicable taxes, which will be added at checkout.

4. License Grant

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to:

  • Install and use the software on one (1) computer per license
  • Use the Service for commercial purposes at your business location
  • Access game content included in your subscription plan

5. Restrictions

You may not:

  • Copy, modify, or distribute the software
  • Reverse engineer, decompile, or disassemble the software
  • Share license keys or credentials with third parties
  • Use the Service on more machines than your license permits
  • Circumvent license verification or game protection systems
  • Use the Service for illegal purposes

6. Machine Activation

Each license is tied to a single machine. You may transfer your license to a new machine by deactivating it from the previous machine first. Attempting to use one license on multiple machines simultaneously is prohibited and may result in license termination.

7. Intellectual Property

The Service, including all software, games, graphics, and content, is protected by copyright and other intellectual property laws. Bamigos retains all rights not expressly granted in these Terms.

8. Updates

8.1 Software Updates: We may release updates to improve functionality or security. Updates are included with all subscription and perpetual licenses.

8.2 Content Updates: New games and features may be added periodically. Access depends on your subscription plan.

9. Termination

We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL BAMIGOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
